General terms and conditions of use [crowdtesting.hub.brussels]
Welcome to the www.crowdtesting.hub.brussels platform (“Platform“). These terms and conditions of use (together with the documents referred to herein) (“GTC“) govern the use of the Platform by the user (“User“).
The User accepts the content of the GTC without reservation and will be bound by it throughout the existence of their User account.
The User is requested to read the present GTC carefully before using the Platform.

- PRESENTATION – MANDATORY INFORMATION
1.1 The Platform is operated by the public limited company Agence Bruxelloise pour l’Accompagnement de l’Entreprise, acting under the name “hub.brussels”, whose registered office is located at Chaussée de Charleroi, 110, B-1060 Saint-Gilles and registered with the Crossroads Bank for Enterprises under number 678.485.603 (hereinafter “hub.brussels“).

1.2 hub.brussels attaches great importance to the respect of privacy, as set out in its Personal Data Protection Policy X.
1.3 The Platform uses cookies. It can therefore collect standard information automatically. Any information collected indirectly will only be used to track the volume, type and pattern of the traffic using this Platform, develop the design and layout of this Platform and for other administrative and planning purposes and to generally improve the service.
hub.brussels has delegated the management and supervision of cookies to CookieBot (https://www.cookiebot.com/en/).
- PURPOSE
2.1 The Platform is intended for traders and is easy and didactic to use. It allows the User to self-diagnose and receive recommendations/improvement suggestions, contacts and useful tools.
- REGISTRATION
3.1 The User can use the platform without registering. However, to be able to save their data and results, the User is required to create a free account using their email address and a password (“Registration“). They are strongly advised to choose a strong password (using a combination of upper and lower case letters, numbers and symbols) for Registration. The User is responsible for keeping their log-in details confidential.
3.2 When registering, the User agrees that the business address they have provided may be kept by hub.brussels for statistical purposes.
3.3 To use the Platform, the User must be of legal age and capable of entering into a legally binding contract in their country of residence.
- THE PLATFORM
4.1 hub.brussels provides the Platform that allows trader Users to carry out a self-diagnosis of their business, with a view to receiving advice on how to improve their development. This tool is free and does not require registration, except to save your data and results. However, the User is required to provide their name and email address at the end of the questionnaire to receive the results. This personal data will not be used for any purpose other than to send and personalise the email containing the results.
4.2 The Platform also allows Users to send questions to hub.brussels.
- RULES OF GOOD USE
5.1 This clause defines the specific rules applicable to the use of the Platform by the User (“Rules of Good Use“).
5.2 The User must ensure that the email address used for their account is active and regularly checked.
5.3 By using the Platform, the User agrees not to:
- provide false or misleading information when registering.
- use the Platform while the User is suspended or banned by hub.brussels in accordance with Article 5.4.
- engage in unlawful or illegal behaviour.
- modify, disrupt, hack, interrupt or interfere with the Platform.
- unfairly or illegally interfere with or manipulate the coding system or the User feedback system.
- upload or use content without the permission of the content owner, or otherwise infringe on the copyright, trademark or other rights of any third party.
5.4 Failure to comply with these Rules of Good Use constitutes a serious breach of the GTC and may result in hub.brussels unilaterally taking any or all of the following actions (with or without warning):
- the immediate, temporary or definitive withdrawal of the right to use the Platform.
- the immediate, temporary or definitive deletion of all or part of the content available on the Platform.
- the bringing of legal action, including the recovery of all the costs incurred as a result of non-compliance with these Rules of Good Use (including, but not limited to, reasonable administrative and legal costs).
- the disclosure of this information to the competent authorities if hub.brussels considers it necessary.
5.5 hub.brussels may investigate any suspected non-compliance with the Rules of Good Use. During the course of an investigation of this nature, hub.brussels is entitled to temporarily deprive the User of the right to use the Platform or to delete all the comments posted by the User without warning.
5.6 The list of measures described in paragraph 5.4 is not exhaustive, as hub.brussels may take any other measure that it deems appropriate.
- INTELLECTUAL PROPERTY
6.1 The User accepts and acknowledges that hub.brussels is the owner or licencee of all intellectual property rights relating to the Platform and its content. Unless expressly stated in these GTC, the User does not have any intellectual property rights or licencing rights to the Platform or its content.
- HYPERLINKS
7.1 hub.brussels welcomes the creation of links to its Platform. However, permission must be sought and obtained. The User can send a request to hub.brussels, which will process it as soon as possible. hub.brussels reserves the right to demand the removal of a link to one of its web pages if it considers that maintaining the link does not correspond to its missions. The following are prohibited via links: the presentation of a page of this site in a frame not belonging to hub.brussels, as well as the insertion of an image belonging to hub.brussels in a page not belonging to it.
7.2 The Platform may provide links to other websites maintained by others and references to other sources of information. These links and sources of information are made available to the User for information purposes only. hub.brussels does not control these sites and the information contained therein and therefore shall not be held responsible for the availability of the other sites to which it directs, nor for the content, advertisements, and products offered by these sites, nor the quality and/or completeness of the information.
7.3 hub.brussels declines all liability for damages that may result from the consultation of information present on other sites or in other sources of information in general, and to which it links, in particular in the event of losses or damages caused or allegedly caused during connections to these sites.
- LIABILITY OF HUB.BRUSSELS
8.1 hub.brussels provides access to the Platform and its content on an “as is” and “as available” basis. hub.brussels provides no declarations or guarantees, express or implied, as to the content and availability of the Platform, including but not limited to access time, errors or correction of faults.
8.2 The Platform, including the information obtained from the use of the self-diagnostic tool, is provided for general information purposes only. hub.brussels makes every effort to ensure the accuracy of such information, but makes no guarantee of any kind as to the completeness, accuracy, reliability or suitability of such information for any particular situation. The User is always obliged to consider this information critically and, if they deem it appropriate, to seek professional advice (particularly in the legal and accounting fields).
8.3 To the fullest extent permitted by law, hub.brussels disclaims all liability for any damage directly or indirectly related to the use of the Platform and the information obtained through it.
- FORCE MAJEURE
9.1 hub.brussels shall not be liable to the User for any delay or failure to perform any of its obligations where there is a case of force majeure. Such events include, but are not limited to: natural disasters, governmental acts, war, fire, flood, explosion, epidemic, pandemic, power failure, computer disturbance or civil disturbance.
- CONTRACTUAL DOCUMENTS
10.1 The present GTC are applicable to the use by the User of the Platform and the services offered. This document supersedes in full all previous versions of the GTC, which therefore no longer apply.
10.2 These GTC constitute the entire agreement between hub.brussels and the User for the use of the Platform and the services offered on it. If any provision of these GTC is found to be invalid or unenforceable, it shall not affect the remaining provisions.
10.3 No forbearance or delay by hub.brussels in enforcing its rights shall prejudice or restrict the rights of hub.brussels, and no waiver of such rights or waiver of any breach of contract shall be deemed a waiver of any other rights or of any subsequent breach of contract.
- RIGHT TO MODIFY THE GTC
hub.brussels has the right to revise and amend these GTC. hub.brussels will notify the User of any changes to these GTC by email or by posting a notice on the Platform. In this event, the User will have a period of seven days to terminate the contractual relationship without notice or compensation. After this period, the User will be irrefutably presumed to have accepted the new version of the GTC. The same applies (irrebuttable presumption of acceptance) if, during this period of seven days, the User continues to use the Platform, in particular by answering questionnaires or contacting hub.brussels.
- TERMINATION OF THE CONTRACT
12.1 The User is required to immediately cease using the Platform as soon as they consider that they are no longer able to comply with an obligation imposed by the GTC.
12.2 If the User wishes to delete their account and no longer benefit from the service, the User must contact hub.brussels at the email address retail@hub.brussels from the email address associated with their account, to request deactivation.
12.3 In the event of non-compliance with all or part of these GTC, including the Rules of Good Use, hub.brussels may immediately interrupt access to the Platform and close the User’s account.
12.4 hub.brussels reserves the right to delete the Platform at any time and without having to provide any justification. In this event, hub.brussels shall endeavour to notify the User in advance within a reasonable time.
12.5 In the event of the deletion of the User’s account or the deletion of the Platform by hub.brussels under the conditions described in this clause, hub.brussels reserves the right to modify or delete any content that the User has provided, their account or any other information that hub.brussels has. In this event, the User also loses their right to use the Platform, as well as their right to access the content belonging to hub.brussels or to the User. hub.brussels will not pay any compensation for any loss whatsoever.
- CONTACT AND COMMENTS
13.1 For any question relating to the present GTC or to the other documents referred to, hub.brussels may be contacted by email at the following address: retail@hub.brussels.
13.2 hub.brussels assesses the comments of the Users and is always attentive to remarks that can help to improve its services on the Platform. It is understood that by leaving one or more comments, the User relinquishes all rights to such comment(s) and authorises hub.brussels and others to use such comment(s) free of charge, and without restriction.
- APPLICABLE LAW AND COMPETENT JURISDICTION
These GTC are governed by Belgian law. Only the courts of the district of Brussels are competent.
